Timothy Patrick McLanahan claims the 2011 release was “illegally written and produced” from his 1998 script Head On.
He filed legal papers against Tom Cruise, Paramount Pictures and several production companies in December 2013.
The documents have since been obtained and published by Radar Online.
In the court papers, Timothy Patrick McLanahan said he had originally sent his script to the William Morris Agency only to have it turned it down.

“Because the Ghost Protocol film generated close to $1 billion, I am asking for this amount in damages,” said Timothy Patrick McLanahan in the court papers.

According to The Hollywood Reporter, the terms of the settlement are confidential, although each party will be responsible for its own legal costs.

In an article for The Hollywood Reporter, Nicole Kidman says she had to be “coaxed” into doing the kinky sex scenes with Tom Cruise.
Nicole Kidman – now a mother of two with husband Keith Urban – says she struggled with some of the sexual aspects of the movie – and revealed some of the more extreme footage was left on the cutting room floor.
The actress described how Stanley Kubrick had to “coax” her into some of the sexuality in the film in the beginning, but says she never felt it was “exploitive or unintelligent”.

The settlement came just two months after Katie Holmes sensationally lodged the legal papers to end their five-year marriage.
Citing “irreconcilable differences” for the split, the actress requested sole legal custody and “primary residential custody” of Suri.
“We are committed to working together as parents to accomplish what is in our daughter Suri’s best interests,” the former couple said in a joint statement.
“We want to keep matters affecting our family private and express our respect for each other’s commitment to each of our respective beliefs and support each other’s roles as parents.”

Speaking to Grazia a source said: “Tom’s friends and family have urged him to take a break, but he has brushed off their concern.

Once, my husband and I took him out for lunch while they were on location and a waitress said, <<Are you one of the actors?>> Tom said to us, <<Please tell her not to ask me any questions. I’m still in character>>.”
Another time, a row broke out when Eileen Berlin gave him a surprise birthday present – an album in which she had pasted photos of him from fan magazines. Eileen Berlin said: “He screamed, <<I didn’t want to be in the teen mags>>. He threw the album hard at me and it hit me on the cheek.”
Their professional relationship ended in 1983 but they stayed in touch and during a subsequent dinner, Tom Cruise mentioned the Church of Scientology, crediting it with helping him overcome his childhood learning disorder.
