Trump Midterms 2026

OAKLAND — In a dramatic judicial intervention just days before the high-stakes midterm elections, a federal judge has ordered the Trump administration to immediately cease threatening state and local election officials with criminal prosecution over ballot processing.

The scathing eight-page ruling, handed down late Friday night, directly blocks an aggressive, eleventh-hour campaign by the Department of Justice (DOJ) and the Department of Homeland Security (DHS) to force local authorities to sequester thousands of ballots under unproven allegations of noncitizen voting. The emergency order expires on November 16, ensuring protections remain in place through the entirety of the voting and tabulation process.

A ‘Brazen’ Campaign of Coercion

U.S. District Judge Trina Thompson determined that the federal government’s pressure tactics likely violated the Voting Rights Act and the U.S. Constitution. Her decision came in response to an emergency lawsuit filed by civil rights groups and labor unions representing frontline election workers.

The court rejected the administration’s core legal defense, asserting that federal agencies had wildly overstepped their authority into a domain that constitutionally belongs to individual states.

Judge Thompson criticized the administration for attempting to intimidate election workers during the midterm elections, stressing that safeguarding the vote is essential for democracy. She warned that these coercive tactics threaten to disrupt the election and disenfranchise lawful voters.

Subpoenas, Ultimatums, and Data Errors

The conflict began when the DOJ under Attorney General Todd Blanche demanded that officials in numerous counties across California and Washington segregate thousands of flagged ballots. When local administrators cited federal 90-day quiet-period laws against pre-election voter purges, the administration escalated matters:

  • Grand Jury Subpoenas: Criminal investigations and subpoenas targeted local registrars in California.
  • Flawed Federal Lists: Audits revealed the federal lists erroneously flagged eligible naturalized citizens and inactive voters.
  • Systemic Overreach: In a separate hearing, Judge Tanya Chutkan noted similar federal errors in Nevada affecting thousands of eligible voters.

The Political Stakes and the Battle Ahead

President Donald Trump criticized the ruling on social media, while the DOJ quickly appealed to the 9th Circuit Court of Appeals. The ruling provides temporary relief for election workers as the high-stakes midterm elections proceed.
